The Sentencing Council is in the process of developing a sentencing guideline for this offence. In line with the approach set out in the General guideline, until a definitive guideline is available, sentencers may assess the seriousness of an offence and starting point with reference to step one factors in the Common assault guideline and treat the status of the victim as an aggravating factor in determining the sentence.
